Pool Service Agreement

This agreement covers what Sunfish Pool Service does at your pool, what you are responsible for, and how billing works. It applies to every residential weekly service account. Starting or continuing service means you accept these terms.

1. Service Plans
Sunfish offers four plans, listed here from the lightest level of service to the fullest.

Salt and calcium are billed separately on every plan. Anything not checked above is either not part of the plan or available at additional cost. See Section 4.

2. Full Cleaning Service Scope
Essential, Premium, and Sunfish Plan accounts receive one full cleaning visit per week. A full cleaning visit includes:
- Net the surface and the pool floor
- Brush walls, steps, and benches
- Empty skimmer and pump baskets
- Test and balance water chemistry
- Visual check of pump, filter, heater, and visible plumbing
Hourly labor rate
Work outside the weekly scope is billed at $125 per hour, with a thirty minute minimum, billed in fifteen minute increments after the first thirty minutes. Vacuuming is billed at the hourly labor rate.
Sunfish Plan accounts include two vacuum visits per calendar year at no additional labor charge. Additional vacuuming on any plan is billed at the hourly rate.
3. Chemical Service Plan
Chemical Service is a chemistry-only plan. On each weekly visit Sunfish will test the water and add chemicals to bring the pool into balance.
Chemical Service includes no cleaning of any kind. No netting, no brushing, no vacuuming, no emptying of baskets.
Who is responsible for what
On this plan, Sunfish is responsible for water chemistry. You are responsible for the physical cleaning of the pool, including netting, brushing, vacuuming, and emptying baskets.
A pool can turn green, cloudy, or stained from lack of physical cleaning even when the chemistry is correct. Debris consumes chlorine, blocks circulation, and stains surfaces. If that happens on a Chemical Service account, it is not a failure of the plan and it is not covered by the monthly rate. Returning the pool to serviceable condition is billed separately at the hourly labor rate plus chemicals.
Condition requirement
If a Chemical Service pool repeatedly falls out of serviceable condition, Sunfish may require a move to a full cleaning plan as a condition of continuing service. Sunfish will give written notice before making this change.
4. Chemicals and Added Charges
Chemicals included in your plan are listed in the Section 1 table. Anything not included is billed at cost plus handling on the next invoice. Salt is billed separately on every plan.
Charges that fall outside the monthly rate on any plan include salt, chemicals not listed as included for your plan, filter cleans beyond those included, vacuuming beyond what your plan includes, parts, equipment, and repair labor.
5. Billing
Service is billed monthly in advance. Payment is by autopay with a card or bank account kept on file. The invoice is issued at the start of the service month and is due on the invoice date.
The monthly rate is annualized. Some months contain four service visits and some contain five. The rate does not change month to month, and no credit is issued for a four visit month.
Added charges from Section 4 appear on the following month's invoice.
6. Late Payment, Suspension, and Collection
An account is past due beginning the day after the invoice due date. The following applies to every plan.
- 14 days past due: service is suspended. No visits are performed while an account is suspended. Suspended visits are not made up and no credit is issued for them.
- Restart charge: $25. When the past due balance is paid in full, service resumes on the next regularly scheduled visit day for your property. A $25 restart charge is added to your next invoice.
- 30 days past due: a one time $50 late charge is added to the account.
- 60 days past due: the account may be cancelled and the balance placed with a third party collection agency.
Interest and collection costs
Past due balances accrue interest at ten percent per year from the date the balance becomes past due, calculated on the unpaid amount.
If an account is placed for collection, you agree to pay Sunfish's actual and documented costs of collection, including third party collection agency fees and court filing costs, in addition to the unpaid balance, interest, and the charges above. Sunfish will provide documentation of those costs on request.
Why these amounts
The $25 restart charge and the $50 late charge are not penalties. They are the parties' reasonable estimate of what a suspension and a past due account actually cost Sunfish in administrative time, route rescheduling, and account follow up. The parties agree that the actual cost of those events is impracticable and extremely difficult to determine in advance, and that these amounts are a fair approximation of it.
Condition during suspension
Suspension does not waive any amount owed. A pool that declines in condition while an account is suspended is the customer's responsibility. Returning it to serviceable condition after service resumes is billed separately at the hourly labor rate plus chemicals, and is not covered by the monthly rate or by the restart charge.
7. Holidays
When a scheduled visit falls on a holiday, Sunfish will perform a make up visit in the same week or the following week.
Sunfish does not run routes during Thanksgiving week and Christmas week. Pools are prepped before those weeks and rebalanced after. Because monthly rates are annualized across the year, no credit is issued for those weeks.
8. Access
You are responsible for providing safe and unobstructed access to the pool and equipment on your service day. That includes an unlocked gate or a working gate code, and dogs secured away from the pool area.
If the technician cannot access the pool because the gate is locked, the code has changed without notice, or a loose dog makes the yard unsafe, the visit is counted as performed. No make up visit is owed and no credit is issued. Sunfish will notify you the same day.
If you change a gate code or lock, tell Sunfish before your next service day.
9. Customer Responsibilities
- Keep the water level at the middle of the tile. Low water starves the pump. Sunfish is not liable for pump or equipment damage caused by low water.
- Keep the equipment powered and the timer running for the hours Sunfish specifies for the season.
- Tell Sunfish about equipment problems, leaks, or unusual water loss as soon as you notice them.
- Keep pets, children, and obstructions clear of the equipment pad.
- On Chemical Service, perform the physical cleaning described in Section 3.
10. Repairs
Repairs are not included in any plan. When Sunfish finds a problem, you get a written quote. Work begins after you approve it.
The exception is emergency stabilization: if equipment is failing in a way that will cause further damage or create a safety hazard, Sunfish may take the minimum action needed to stop the damage, such as shutting off a leaking system, and will notify you immediately.
Parts and repair labor are billed separately from the monthly rate.
11. Filter Cleaning
Filters need cleaning on a regular schedule to keep circulation and chemistry working. Filter cleans are billed separately on Essential, Premium, and Chemical Service accounts. A standard four cartridge filter clean is $100. Other filter types are quoted before the work. The Sunfish Plan includes two filter cleans per calendar year.
Sunfish will recommend a filter clean when the pressure reading or the condition of the water calls for it.
12. Weather and Safety
Sunfish may skip or reschedule a visit for lightning, high wind, heavy rain, extreme heat, hazardous air quality, or any condition that makes it unsafe to work. Skipped visits are rescheduled where the route allows.
Normal storm cleanup is part of a regular visit. Debris removal well beyond normal cleanup, such as after a major storm or tree failure, is billed at the hourly labor rate.
13. Pre-existing Conditions
Sunfish is not responsible for conditions that existed before service started, including stains, plaster damage, scale, calcium buildup, equipment at the end of its service life, and prior chemical damage. Sunfish will point these out and quote a remedy where one exists.
Bringing a neglected or green pool to serviceable condition is a separate service. It is quoted and billed separately from weekly service.
14. Plan and Rate Changes
You may change plans at any time. A plan change takes effect at the start of the next billing cycle.
Sunfish will give at least 30 days written notice before any change to monthly rates or to the hourly labor rate. Continuing service after the notice period means you accept the new rate.
15. Cancellation
Either party may cancel with 14 days written notice. Email to billing@sunfishswim.com counts as written notice.
Payments are non-refundable and are not prorated. There are no mid month refunds. Service runs through the end of the month you have paid for, and the account closes at the end of that month.
Sunfish may also cancel an account under Section 6 for nonpayment, or under Section 3 if a Chemical Service pool repeatedly falls out of condition and you decline to move to a cleaning plan.
16. General Terms
Term. This agreement is month to month. There is no long term contract and no cancellation penalty beyond the notice period in Section 15.
Acceptance. Starting service, continuing service, or paying an invoice means you accept these terms.
Governing law. This agreement is governed by the laws of the State of California. Venue is Sacramento County.
Severability. If any part of this agreement is found unenforceable, the rest stays in effect.
Entire agreement. This document, together with your current invoice and any written quote you have approved, is the entire agreement between you and Sunfish Pool Service. It replaces any earlier version.
Changes. Sunfish may update these terms with 30 days written notice. The current version is always posted at sunfishswim.com/service-agreement.
