Terms of Service

These terms govern your use of sunfishswim.com and any request you submit through it. By using this site you agree to them. If you do not agree, please do not use the site.

1. Who we are

Sunfish Pool Service provides weekly pool maintenance, green-to-clean recovery, and pool equipment repair in the greater Sacramento, California area. You can reach us at (916) 313-8754 or info@sunfishswim.com.

2. Using this site

You may use the site for your own personal or business purposes related to pool service. You may not scrape it, copy it wholesale, interfere with it, attempt to gain unauthorized access to it, use it to send unsolicited messages, or use it for anything unlawful.

3. Requests submitted through the site are not a binding agreement

Submitting a form on this site starts a conversation. It does not create a service contract and does not guarantee that we will take on your property. Service begins only when we confirm your service address is in our service area, confirm your plan and rate, assign a service day, and you accept our Service Agreement.

4. Prices, plans, and quotes

Prices shown on this site are current monthly rates for a standard residential pool in normal condition, and they may change. A larger pool, a pool with unusual equipment, or a pool that needs work to bring it current is quoted after we look at it.

Chemicals included in a plan are the ones the plan lists. Salt, calcium, and cyanuric acid are not included on any plan and are billed at our cost. Green-to-clean recovery, repairs, and other work outside the plan are quoted and billed separately.

If a price is displayed in error, we are not obligated to honor it. We will tell you before doing any work at a corrected price.

5. Communications and consent

When you give us your phone number or email address, you agree we may contact you about your request, your service, and your account by phone, text, and email. Message and data rates may apply, message frequency varies, and consent to marketing messages is not a condition of purchase. Reply STOP to opt out of promotional texts or HELP for help. See our Privacy Policy for details, including our commitment never to share your mobile number or SMS consent with third parties for their marketing.

6. Accuracy of what you tell us

We rely on the information you give us to quote and schedule. You agree that the information you submit is accurate and complete, including the condition of the pool. A pool that is green, has been out of service, or has failed equipment at the time of signup requires recovery work that is quoted separately and is not part of a monthly plan. If a pool's actual condition differs materially from what was described, we may re-quote or decline service before the first visit.

7. Access to the property

Weekly service requires safe, unobstructed access to the pool and equipment on the service day, working gate access, and pets secured. If we cannot access the pool, we may be unable to complete the visit, and the visit may still be billed.

8. Photos and content you send us

If you send us photos of your pool or property, you give us permission to use them for service records and, in a form that does not identify your address, in our marketing. Tell us if you would rather we did not, and we will not.

9. Third-party links and services

This site links to and embeds services run by others, including our web forms, scheduling, and payment tools. We are not responsible for the content or practices of third-party sites, and their own terms and privacy policies apply to your use of them.

10. Intellectual property

The Sunfish Pool Service name, logo, site design, photographs, and written content are ours and are protected by copyright and trademark law. You may not reuse them without written permission.

11. No warranty on site content

The site is provided as is. We work to keep the information on it current and accurate, but we do not warrant that it is error-free, uninterrupted, or fit for a particular purpose. Pool care information published here is general guidance, not a professional assessment of your pool.

12. Limitation of liability

To the fullest extent permitted by California law, Sunfish Pool Service is not liable for indirect, incidental, special, or consequential damages arising from your use of this site. Our total liability arising out of your use of the site will not exceed one hundred dollars. Nothing here limits liability that cannot be limited by law, and nothing here limits or replaces the terms of our Service Agreement for work we actually perform.

13. Indemnity

You agree to indemnify Sunfish Pool Service against claims arising from your misuse of this site or your violation of these terms.

14. Governing law and disputes

These terms are governed by the laws of the State of California without regard to its conflict-of-laws rules. Any dispute arising out of the site will be brought in the state or federal courts located in Sacramento County, California, and you consent to that venue.

15. Changes to these terms

We may update these terms. The date at the top shows when they last changed, and continued use of the site after a change means you accept the updated terms.
